Terms of Service

The short version: use Vesper for your own planning, Vesper Pro is a subscription billed through Stripe, weather and AI answers come with no guarantees, and we provide the Service as-is.
Agreement
These Terms of Service (“Terms”) govern your use of Vesper (“Vesper,” the “Service”) — the Vesper website and app — provided by Carpenter Create LLC, a Texas limited liability company (“we,” “us”). By using Vesper, you agree to these Terms and to our Privacy Policy.
Eligibility
You must be able to form a binding contract to use Vesper, and you are responsible for following any laws that apply to you. Vesper is not directed to children under 13.
The service
Vesper is a weather app whose planner (“Ask Vesper”) answers your questions using current and forecast weather data. Answers are grounded in real data from Open-Meteo and generated with the help of AI. You can use Vesper signed out, with your saved cities kept on your device; signing in with a magic link syncs your cities, preferences, and plans across devices.
Your account
Sign-in uses a one-time magic link sent to your email — Vesper has no passwords. You are responsible for the email account you use to sign in and for activity under your account. Tell us promptly if you believe your account has been accessed without your permission.
Vesper Pro & billing
Vesper Pro is an optional paid subscription that unlocks the full planner, saved plans, and other Pro features. New accounts include a free trial period; a payment method is required only to continue as a paid subscriber. Subscriptions are offered on a monthly or annual basis at the price shown at checkout, are billed in advance through our payment processor (Stripe), and renew automatically at the then-current price until canceled. You can cancel anytime from your account’s billing settings; cancellation takes effect at the end of the current billing period and you keep Pro until then. Except where required by law, payments are non-refundable and we do not provide partial-period refunds — contact us if you believe there’s a billing error. We may change prices or features with reasonable notice, effective on your next renewal. Payments are handled by Stripe under its terms; Vesper never sees or stores your full card details.
Weather & AI — no guarantees
Weather is inherently uncertain. Vesper’s forecasts, indices, and planner answers may be inaccurate, incomplete, or unavailable, and beyond about 16 days Vesper shows typical historical conditions — clearly labeled as “typical,” not a forecast. Ask Vesper is AI-assisted and can make mistakes. Do not rely on Vesper for safety-critical decisions — including aviation, marine, severe-weather, medical, or emergency situations. Always consult official sources such as your national weather service for those.
Acceptable use
You agree not to reverse-engineer, resell, scrape, overload, or misuse the Service, and not to use it for unlawful purposes, except to the extent applicable law permits.
Your content
Your saved cities, preferences, and the plans and questions you send to the planner remain yours. You grant us the limited license needed to store and process that content to operate the Service for you (see the Privacy Policy for details). You can delete your account, which removes that content.
Ownership
Vesper — including the Service, the “Vesper” name, its design, and its content — belongs to Carpenter Create LLC and is protected by intellectual-property laws. These Terms grant you a personal, non-exclusive, non-transferable, revocable license to use the Service; they do not transfer any ownership to you.
Third-party services
Vesper relies on third parties to operate — including Supabase, Anthropic, Stripe, Vercel, Resend, and Open-Meteo. Your use of Vesper may also be subject to their terms, and we are not responsible for third-party services we do not control.
Disclaimer
Vesper is provided “as is” and “as available,” without warranties of any kind, express or implied — including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or accurate.
Limitation of liability
To the maximum extent permitted by law, Carpenter Create LLC will not be liable for any indirect, incidental, special, or consequential damages, or for any decision made in reliance on the Service, arising from your use of Vesper.
Termination
You can stop using Vesper at any time by canceling any subscription and deleting your account. We may suspend or end your access if you materially breach these Terms. Provisions that by their nature should survive — ownership, disclaimers, and limitation of liability — continue after termination.
Changes
We may update these Terms from time to time. Continued use of Vesper after a change means you accept it, and we’ll revise the date above.
Governing law and venue
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws principles. You agree that the exclusive venue for any dispute arising out of or relating to these Terms or your use of Vesper will be the state or federal courts located in Dallas County, Texas, and you consent to the personal jurisdiction of those courts. Where mandatory local consumer-protection law gives you a different right, that law still applies.
